1. Acceptance of Terms
By accessing or using BIDigest ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.
2. Description of Service
BIDigest provides AI Visibility Intelligence services, including:
Tracking how AI assistants (ChatGPT, Claude, Gemini, Perplexity) recommend businesses
Weekly BI Digest reports with visibility metrics
Competitive benchmarking and analysis
Optimization recommendations
White-label reporting for agencies
Compliance tracking and monitoring (for enterprise clients)
Tracking records with timestamps and proof storage
Service Nature: BIDigest is a data tracking and reporting service. We observe and record how AI platforms respond to queries about your business. We do not control, influence, or guarantee AI platform responses. We provide tools to help you understand your AI visibility; we do not provide legal, compliance, or regulatory advice.
Important Limitations
We do NOT guarantee rankings. We track and report visibility; we cannot control AI outputs.
We do NOT manipulate AI systems. We observe and analyze, not influence.
We do NOT guarantee business outcomes. Visibility insights may not translate to sales.
AI platforms may change. Third-party AI systems can modify their behavior without notice.
3. User Accounts
You are responsible for maintaining the confidentiality of your account and password. You agree to:
Provide accurate business information
Keep your login credentials secure
Notify us of any unauthorized access
Accept responsibility for all activities under your account
Strategic ($299/mo): Full features, custom queries, priority support
Billing terms:
30-day free trial on first paid subscription
Monthly billing on activation anniversary
Annual plans: 20% discount, billed upfront
No refunds for partial months
5. Cancellation
You may cancel at any time:
During trial: No charge, immediate cancellation
Monthly plans: Access continues until end of billing period
Annual plans: Access continues until end of annual period (no refund)
To cancel: Dashboard → Account → Subscription → Cancel, or email support@bidigest.com
6. Intellectual Property
Your Data: You retain all rights to business information you provide.
Our Technology: BIDigest platform, algorithms, report formats, and AI Visibility Score methodology are our intellectual property.
Report Usage: You may share reports with your clients and quote metrics (with attribution). You may not resell our service without agreement.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

Results may vary by time, location, and AI model version

TRACKING RECORDS: While our tracking records include timestamps, proof storage, and audit trails, the admissibility of evidence in legal proceedings depends on jurisdiction-specific rules. Consult with legal counsel regarding use in litigation.
NO REGULATORY REPRESENTATION: We do not represent or warrant that our service meets any specific regulatory requirements. You are solely responsible for ensuring compliance with applicable laws and regulations.
THIRD-PARTY AI PLATFORMS: We track responses from third-party AI platforms (ChatGPT, Claude, Gemini, Perplexity). We have no control over these platforms and are not responsible for their responses, accuracy, or changes to their behavior.
8. Limitation of Liability
Maximum Liability: Our liability is limited to the greater of (a) subscription fees you paid to BIDigest in the past 12 months, or (b) $500 USD.
Note: "Subscription fees" refers to your BIDigest payments, not legal fees or any other fees.
We are not liable for:
Lost profits or revenue
Business interruption
Data loss (you should maintain backups)
Third-party AI platform changes
Decisions made based on our reports
Indirect or consequential damages
Regulatory fines, penalties, or sanctions resulting from compliance violations
Legal fees, court costs, or litigation expenses of any kind
Loss of licenses, certifications, or professional standing due to compliance issues
Reputational damage or loss of business relationships
Incorrect compliance determinations or false positives/negatives in violation detection
Compliance Liability Waiver: By using our compliance tracking service, you acknowledge that BIDigest is a data tracking and reporting tool, not a compliance advisor. You agree to hold BIDigest harmless from any claims, damages, or liabilities arising from your use of our tracking data for compliance purposes, regulatory filings, or legal proceedings.
9. Governing Law
These Terms are governed by the laws of Delaware, USA. Disputes will be resolved by binding arbitration in Wilmington, Delaware.
10. Changes to Terms
We may update these Terms with 30 days notice via email. Continued use after changes constitutes acceptance.
